toYou may cancel your subscription at any time within the first seven (7) days of your monthly subscription at no cost or cancellation fee. If you cancel your subscription after the first week of your monthly plan you're still held liable to make a final payment for that month. Refunds will not be provided for any subscription. As of June 7, 2019, we will no longer be providing full service for cancelled plans with accumulated integrated minutes. Those with integrated minutes will be provided with basic phone service. Messaging, appointment setting , reminders and all other features will be reserved for paying clients only. We do not provide credit, refunds, or prorated billing for subscriptions that are not supported by the cancellation policy within the Terms and Conditions.
Subscribers must agree that no provided services will be used for illegal purposes. Any subscriber found to be using our provided Services illegally will be subject to immediate cancellation of all services rendered without prior notification.
Quoted rates are determined by the subscriber's request and are listed along with our monthly plans and services provided. Our rates are subject to adjustment at the time of subscriber notifies Cindy's Communications Inc. with instructions for the account such as modifying a monthly plan. The Service is subject to an annual increase of 7%.
Subscribers have no ownership over their assigned telephone number. Subscribers acknowledge that all telephone numbers are provided on a rental basis only and are the sole property of Cindy's Communications Inc. The subscriber acknowledges and accepts the potential risk of publishing and or distributing their phone number(s).
Uninterrupted services will be automatically renewed on a month-to-month basis unless canceled in writing via email by the subscriber. Subscriptions must be cancelled within the first 7 days of any monthly plan or the account will be charged for that month. Subscriptions with the call-forwarding feature must notify the agency of its cancellation 30 days in advance. Any subscription with the call-forwarding feature that fails to notify the agency or properly cancel the feature will pay a bookkeeping fee of $50 and $5 per call forwarded to our lines.
This agreement will become effective at the time of the subscription. From the time services commence, payment for the first month of service is due. All rates will be billed in advance monthly. The agency considers accounts to be delinquent when not paid by the due date on the receipt and are subject to a $35.00 bookkeeping fee. This fee will continue every month until the account is up-to-date and payment is received. Fees not paid by the due date may result in forfeiting the account's accumulated integrated minutes as well as termination and/or interruption of service without any notification. Subscribers must call the agency to request an extension on any upcoming payments. The request must be made 7 days before the account is to be renewed. Any extensions given will be no more than 5 days.
When cancelling the service, the subscriber must notify the servicing agencies billing department within 30 days of the invoice date. No adjustments are considered beyond a 30-day period. The subscriber-base rate allowance includes all answered calls, non-messages, callers asking for company hours, hang ups and other calls.
The subscriber agrees to pay a service charge of $30.00 for any check returned by the bank, regardless for reason.
The subscriber agrees to pay all costs resulting in the legal dispute and or the collection of monies due. The prevailing party and any legal dispute will be entitled to damages and attorney's fees.
The agency extends significant messages for at least 90 days of origination. However, the agency cannot guarantee that messages will be preserved beyond the original date of delivery to the subscriber. The telephone agents may have access up to 7 days of recent messages. Any message requests beyond 7 days old must be directed to a supervisor.
Upon request, the agency will provide duplicate message copies for a fee of $20.00 plus postage.
All precautions will be taken to provide continuous, 24-hour service. By signing up for service, the subscriber concedes that uninterrupted service isn't guaranteed. Service interruptions may result without prior notification due to electrical outages at the facility, telephone utility service failures, natural disasters, including floods, fire, earthquakes, order by law enforcement or public agency for evacuation of the premises or equipment malfunctions. The sole liability of the agency to the subscriber and the case of any such interruptions to provide a pro-rata credit is based upon the monthly service rate for a 24-hour period of interrupted service.
The agency is not liable to the subscriber for errors or omissions in the transmission of calls due to the difficulties that can arise when transmitting verbal messages over the phone.
Fees paid to the agency are based solely upon the value of the service as well as services rendered and the scope of liability set forth is unrelated to this value. The subscriber agrees that the maximum financial liability of the agency shall be strictly limited to the charges build providing services during the monthly service during which a claim arises. In no event shall the servicing agency be liable for special or consequential damages, and not limited to loss of prospective sales, loss of profits, or third party claims against a subscriber.
